Course profile: Investigations, Grievances and Disciplinaries: An overview (1 day)

Employment in the UK is governed by a range of legislation and Good Practice standards that serve to protect the employer and employee and create fairness in the workplace. Failure to comply with these laws and guidelines can lead to very expensive, distressing and time consuming litigation at worst and a very unhappy workforce at least. This course aims to provide managers with a range of information regarding this very sensitive topic so that issues are explored in a positive manner, to the benefit of both parties and indirectly, service users.

Learning objectives:

By the end of the course participants will have an understanding of:

  • why an organisation and its staff need a grievance and a disciplinary procedure
  • when and how a grievance procedure can be used
  • when and how a disciplinary procedure can be used
  • the investigation process: why it is so important and how it can go wrong
  • Course content:

  • The grievance procedure: how and when can it be invoked?
  • The disciplinary procedure: how and when can you use it?
  • Stages of an investigation
  • In what ways can an investigation go wrong?
  • Witnesses and witness statements
  • Managing the complainant and the alleged perpetrator
  • Conducting an interview
  • The importance of procedural fairness and of recording
  • Misconduct outside of work
  • Reference will be made to relevant legislation/best practice throughout the day
